Hofstra University recently filed a special Article 78 lawsuit against the Nassau County Planning Commission for violating important laws in New York State and Nassau County. The Planning Commission failed to properly recognize and proceed with the meeting in view of the transfer of the leasehold of the Nassau Hub and its surrounding public property from its current tenant to Las Vegas Sands for casino development.
"We are asking the planning committee to commission for a fair and transparent process," said University of Hofstra spokesperson Terry Coniglio. "So far, the planning committee's hearings have not complied with the law, and we have been forced to ask the court to ensure that the public receives the information they deserve and a fair opportunity to be heard on this important issue."
The Nassau County law requires public hearings to be held before the Planning Commission decides whether to recommend lease transfers to the County Executive and County Legacies, which must comply with New York's Open Meetings Law.
The planning committee claimed to have held such a meeting on March 2, 2023, but it was not informed in advance of the Las Vegas Sands-related meeting or the transfer of county property for casino development, and no conditions were disclosed to the public regarding the lease offer. Although the planning committee acknowledged that the lease transfer was still under negotiation, the opinion released on March 2 was considered private.
As stated in the petition to the court, the planning committee violated the law on March 2 and other meetings by denying the right to attend "work sessions" and scheduling meetings for the private interest of Las Vegas Sands.
